1. Agreement to Terms

By downloading, installing, or using TradingLabs by ATJ (“App”), you (“User”) agree to be legally bound by these Terms & Conditions. If you do not agree, you must not use the App.

2. Nature of the App

The App is a Windows-based analytical tool that processes MetaTrader 5 (“MT5”) data locally. The App provides dashboards, statistics, journal features, and trade visualisations.
The App does not execute trades and has no capability to open, modify, or close trading positions.

3. Data Handling

3.1 Local Processing

All MT5 data, including account information (login number only), trade history, trading statistics, and journal notes, is stored and processed exclusively on the User’s device unless otherwise stated.

​

3.2 Optional Data Collection

The App may collect non-identifiable analytical, diagnostic, and usage data for the purposes of:

  • performance monitoring

  • feature improvement

  • marketing analytics

Such collection is performed only with User consent and in compliance with GDPR, CCPA, and other applicable laws.

3.3 No Transmission of Trading Credentials

The App does not collect or process MT5 passwords, broker credentials, or authentication keys.

​

4. No Liability for Trading Actions

Because the App cannot place or influence trades, the developer bears no responsibility for:

  • any trades executed on the User’s MT5 account

  • trading losses, financial decisions, or market outcomes

  • errors in third-party platforms such as MT5 or broker services

The User remains solely responsible for all trading activity and risk management.

5. App Versions

Current and previous App versions are made available through the official website for verification and transparency. Features may change without prior notice.

6. Intellectual Property

All intellectual property rights in the App remain the exclusive property of the developer. Users receive a non-transferable, non-exclusive license for personal or internal business use.

7. Warranty Disclaimer

The App is provided “as is”, without warranties of any kind, including but not limited to accuracy, reliability, performance, or fitness for a particular purpose. Use of the App is at the User’s own risk.

8. Limitation of Liability

To the fullest extent permitted by law, the developer shall not be liable for:

  • direct, indirect, incidental, consequential, or punitive damages

  • trading and financial losses

  • data loss or corruption
     

9. Compliance

The developer complies with GDPR (EU), CCPA (California), CPRA, Virginia CDPA, Colorado Privacy Act, and applicable international standards relating to personal data.

10. Modifications

We reserve the right to amend these Terms at any time. Continued use of the App constitutes acceptance of the updated Terms.

​

11. Governing Law

These Terms shall be governed by the laws of the Czech Republic, without regard to conflict-of-law provisions.
